Women and Child Development Minister Maneka Gandhi has urged Delhi Chief Minister Arvind Kejriwal to ensure that doctors in government hospitals are not denied maternity leave. Gandhi wrote a letter to Kejriwal following a media report which claimed that several government hospitals in the city either denied maternity leave to women resident doctors serving in the hospital on ad hoc basis or asked them to resign when they broached the topic.      The Media report claimed that this was a common practice in hospitals like Baba Saheb Ambedkar, Guru Tegh Bahadur, Govind Ballabh Pant and Lok Nayak hospitals, and the Municipal Corporation of Delhi (MCD)  Hindu Rao Hospital .        “It is important for us in the government to ensure that the working conditions are suitable as well as enabling for working women. For this, extended maternity leave is one of the factors. “I, therefore, request you to ensure that women doctors are not denied these benefits under any circumstances,” Gandhi said. Her letter said she has been informed that not just temporary resident doctors but regular doctors are also denied maternity benefits. The Maternity Benefit (Amendment) Bill, 2016, passed by Parliament last month, extends paid maternity leave from 12 weeks to 26 weeks and is applicable to all organisations with 10 or more employees.it could be availed by women for a period extending up to 8 weeks before the expected delivery date and remaining 18 weeks can be availed post childbirth. For women who are expecting after having 2 children, the duration of paid maternity leave shall be 12 weeks (i.e., 6 weeks pre and 6 weeks post expected date of delivery).      It is a constitutional crime if any Hospital or Medical college whether private or Government or any Office refuse to grant Maternity Medical leave for  Under the MB Amendment Act,not only this,even crèche facility mandatory for every establishment employing 50 or more employees. Women employees would be permitted to visit the crèche 4 times during the day.The MB Amendment Act makes it mandatory for employers to educate women about the maternity benefits available to them at the time of their appointment. The MB Amendment Act has come into force from 1 April 2017. All establishments covered under the MB Amendment Act would be required to amend their existing maternity benefit policies in accordance with the MB Amendment Act with effect from 1 April 2017.Any Organisation cannot differentiate employee on the basis of Temporary/contractual and permanant worker as clearly and loudly stated by Apex court of our country,Supreme Court.In State and central tribunal court ,Employee and Doctors employed but paid very less salary & other frebbies comapre to permanant Doctors in name of Illegal Contractual worker have filed cases and judgement should come but is unnecessary delayed due to long lasting time taking Judiciary of our country .           What to talk of maternity Leaves,all leaves,facilities ,Health Insurances and payments made to employee whether contractual or permanant should be same but MANY GOVERNMENT and Private organisations are employing Employees as contractual giving them almost 1/  or 1/3rd pay than to Permanant employeee with no insurance,health,PF ,house rent and DA expenses or care although they work for same hours which is a pure exploitation of these employees (only on this ground many Lady workers,doctors denied maternity leaves).This is very much practised in hospital sector particularly in PRIVATE & GOVERNMENT MEDICAL COLLEGES to recruit teacher Doctors and other staffs to cut expense of Medical college illegally.         Like Women welfare Minister Smt,Maneka Gandhi,Labour Ministry should pay attention to this and strict action should be taken against those who are violating Supreme court order openly for the reason best known to them.Any good sense will only prevail if Babus doing this are punished and the amount not paid to these employee is cut from the salary or pension of these Babus who knowing all facts are compelling their political boss to apply and practice such illegal rules and exploit employees badly.
